  • Important notes before you start

  • BEFORE YOU START THIS QUESTIONNAIRE, PLEASE COLLECT THE DOCUMENTS YOU WILL NEED TO UPLOAD

    To be eligible for resident tuition, you must satisfy only one of the six tests below.   The tests go from the simplest (#1, fewest documents) to the most complex (#6, most documents).  Determine the lowest-numbered test you can satisfy, and then have those documents ready to upload.

    Eligibility Test Have these documents ready to upload
    1. Attended a Texas public university/college in the past year and were classified as a resident. A letter/email from the institution OR a PDF file from the student portal which certifies that the institution classified you as a resident and entitled to the in-state tuition.
    2. Graduated from a Texas high school or acquired a Texas GED in the past 12 months. Final high school transcript with a graduation date OR GED certificate.
    3. You, your spouse, or your parent/guardian are a member of the US military and have Texas residency

    Veteran: DD-214 OR Certificate of Eligibility

    Active: Two Leave and Earnings Statements: most recent, and 12 months ago.

    4. You have established and maintained domicile in Texas

    You need to submit documents for EACH OF THESE THREE:

    1) Documents which prove you have lived in Texas for the past 12 months: either utility bills, bank statements, credit report, voter registration, or lease/rental agreement.  For utility bills and bank statements, have the most recent and one from 12 months ago.

    2) Documents which prove 12 months of either employment, home ownership, business ownership, or public assistance.  If the documentation is monthly (e.g. a paystub), have the most recent AND one from 12 months ago.

    3) If you are not a US citizen, a document which proves that you are one of the following: permanent resident, applied for permanent residency, parolee, refugee, temporary protective status, or otherwise belong to a class eligible for Texas domicile.

    5. Your spouse of the past 12 months has established and maintained domicile in Texas

    1) The documents required by #4 above, but for your spouse AND;

    2) Proof of marriage lasting greater than 1 year.

    6. Your parent/guardian has established and maintained domicile in Texas

    1) All the documents listed in #4 above, but for your parent/guardian AND;

    2) The first page of the parent/guardian's most recent tax return which shows you as a dependent.

     

    • This form can be used for both initial determination of residency and also by students seeking reclassification.
    • All documentation must be submitted each semester prior to the census date of that semester.  The census dates for each semester can be found on the university's academic calendar.
    • If documentation is submitted after the semester's census date, the change will take effect in the next proceeding semester.

  • 6 Basis of Claim to Residency

  • NOTE: An independent tax payer should not be claimed as a dependent for tax purposes by another person.  If you file a joint return with your spouse, answer "yes"

  • NOTE: To be eligible to be claimed as a dependent, your parent or legal guardian must provide at least one-half of your support.  A step-parent does not qualify as a parent if he/she has not adopted the student.

    • 7.5 ELIGIBLE CATEGORIES

      • Classified by the USCIS as a Refugee, Asylee, Parolee, Conditional Permanent Resident, or Temporary Resident;
      • Holding Temporary Protected Status, and Spouses and Children with approved petitions under the Violence Against Women Act (VAWA), an applicant with an approved USCIS I-360, and a person granted deferred action status by USCIS;
      • Who has filed an application for Cancellation of Removal and Adjustment of Status under Immigration Nationality Act 240A(b) or a Cancellation of Removal and Adjustment of Status under the Nicaraguan and Central American Relief Act (NACARA), Haitian Refugee Immigrant Fairness Act (HRIFA), or the Cuban Adjustment Act, and who has been issued a fee/filing receipt or Notice of Action by USCIS; and
      • Who has filed for adjustment of status to that of a person admitted as a Permanent Resident under 8 United States Code 1255, or under the "registry" program (8 United States Code 1259), or the Special Immigrant Juvenile Program (8 USC 1101(a)(27)(J)) and has been issued a fee/filing receipt or Notice of Action by USCIS.
